Extra-Judicial Settlement explanation, complete process and requirements

EXTRA-JUDICIAL SETTLEMENT
Explain; - ang Extra-Judicial Settlement ay ginawaga ito pag ang Registered owner na nakalagay sa 
Transfer Certificate of Title ng real property ay NAMATAY, ang ibig sabihin ay ililipat ang pangalan sa mga taga pag mana ng property, (Asawa at mga anak) ang consequences kung hindi ito nagagawa
ng mga taga pag mana mag susufer ka ng surcharge, penalty and interest sa Bureau of Internal revenue.




COMPLETE PROCESS OF EXTAR-JUDICIAL SETTLEMENT AND REQUIREMENTS

Step 1-A. BUREAU OF INTERNAL REVENUE located under the jurisdiction of principal
resident of the deceased person.

APPICATION OF CAR- Certificate Authorizing Registration
Requirement:
1.) Notarized Extra-Judicial Settlement 
2.) PSA Death Certificate
3.) Birth Certificate of Heirs / Married Contract
4.) Certified True Copy of Transfer Certificate of Title
5.) Certified True Copy of Tax Declaration Land and Improvement
6.) If Lot only Certificate of No Improvement
7.) Certificate of land Holding
8.) Tax Clearance
9.) Valid I.D. of all Heirs
10.) Tin Number
11.) Proof payment of ESTATE TAX
Processing time more or less 1 month

Step 1-B) Publication of Extra-Judicial Settlement
                3 consecutive week, with Certificate of Publication
                and attached Publication papers

Step 2 , City Hall or Municipal Treasurer office
Payment of Transfer Tax
Requirement:  photo copy of all documents release from BIR
after processing of Certificate Authorizing registration.

Step 3.) REGISTER OF DEED
Payment of Registration fee
Complete list of Requirement ALL ORIGINAL DOCUMENTS
1.) Original Owners Copy of Transfer Certificate of Title
2.) CAR - Certificate Authorizing Registration
3.) Notarized Extra-Judicial Settlement of the Estate with BIR Stamp
4.) Prof of Payment Transfer Tax 
4.) Certificate of Publication
5.) PSA Death Certificate
6.) Birth Certificate of Heirs / Married Contract
7.) Certified True Copy of Tax Declaration Land and Improvement
8.) If Lot only Certificate of No Improvement
9.) Tax Clearance
10.) Valid I.D. of all Heirs

Step 4.) ASSESSORS OFFICE
Transfer of Tax Declaration to the new owner
Requirements:
1.) New Transfer Certificate of Title
2.) CAR - Certificate Authorizing Registration
4.) Notarized Extra-Judicial Settlement of the Estate with BIR Stamp
5.) Tax Clearance
