Deed of Donation complete process and requirements

DEED OF DONATION COMPLETE PROCESS AND REQUIREMENT

APPICATION OF CAR- Certificate Authorizing Registration
Requirement:
1.) Notarized DEED OF DONATION 
2.) Affidavit of No Previous Donation
3.) Certified True Copy of Transfer Certificate of Title
4.) Certified True Copy of Tax Declaration Land and Improvement
5.) If Lot only Certificate of No Improvement
6.) Valid I.D. of Donors and Donee
7.) Tin Number Donors and Donee
8.) Marriage Contract if marriage if Single Birth Certificate
9.) Proof payment of Donors Tax 6% and Documentary Stamp Tax 1.5%
Processing time more or less 1 month
Under Train Law no restriction Donor and Donees Relationship

Step 2 , PAYMENT OF TRANSFER TAX
City Hall or Municipal Treasurer office
Requirement:  photo copy of all documents release from BIR
after processing of Certificate Authorizing registration.

Step 3.) REGISTER OF DEED
Payment of Registration fee
Complete list of Requirement ALL ORIGINAL DOCUMENTS
1.) Original Owners Copy of Transfer Certificate of Title
2.) CAR - Certificate Authorizing Registration
3.) Deed of Donation with BIR Stamp
4.) Prof of Payment Transfer Tax 
5.) Certified True Copy of Tax Declaration Land and Improvement
6.) If Lot only Certificate of No Improvement
7.) Tax Clearance
8.) Valid I.D. of Donors and Donee
Processing time more or less 1 month

Step 4.) ASSESSORS OFFICE
Transfer of Tax Declaration to the new owner
Requirements:
1.) New Transfer Certificate of Title
2.) CAR - Certificate Authorizing Registration
4.) Deed of Donationa with BIR Stamp
5.) Tax Clearance

Note: Tip to the Donor so that, Still you have control of the property donated
Annotate:
USUFRUCT: (CONDATION)
    That the Donor Shall continue to enjoy all the fruits of the Herein described property during her lifetime
and that the donees cannot sell or otherwise dispose of the herein land without the prior consent and approval by the donor during her lifetime.

* can be cancelled thru (VERIFIED PITION ONLY) if still alive
* this annotation become NOT VALID if the Donor died
